This issue examines legal issues surrounding the use of preloaded video and audio content from the perspective of the teacher/administrator as well as media producers and distributors. It discusses where institutions can use the material, who may access and use the material, and the duration of the allowed use. It explains whether clips can be made and used and are subject to the same restrictions as the entire work as well as whether there are any access limitations encoded into the content. A checklist is included for media producers and distributors. AIME attorney Arnold Lutzker answers a question about fair use related to the conversion of 35mm photo slides to digital files as well as whether a school district can convert VHS titles to DVD.

AIME News, Vol. 22, No. 3, Fall 2008 - Taking Stock : Web 2.0 and the New Era of Content Rights

This issue examines who is responsible for what is posted as well as the role of fair use involving Web 2.0 tools. Focus is placed on two separate court orders from this summer. The first involved Wikipedia (Bauer v. Glatzer et. al.). It tested the principle of user-responsibility and the interactive site disclaimer. The second involved YouTube (Lenz v. Universal Music Corp.). The musician Prince's record label fought to have a home video which used his song taken down. It explores issues involving fair use and the DMCA (Digital Millennium Copyright Act) Takedown Notice. AIME attorney Arnold Lutzker answers a question about the Chaffee Amendment to the copyright law and alternative formats.

AIME News, Vol. 23, No. 2, Summer 2009 - Teach Act : Staying True to Form

This issue revisits the TEACH Act, first passed in 2002. Explaining that the TEACH Act was designed to deal with the problem of computer networks and how to send information to remote locations via the internet. The challenge of this law was to treat the performance or display of copyrighted materials in the same manner as if they were in the classroom at the same time. Highlights of the Act noted in the article are: works affected; rights affected; eligible parties; mediated instructional activities; policies; temporary storage; and conversion from analog to digital. AIME attorney Arnold Lutzker answer a question regarding synchronization rights and other music questions.
